Recent Changes In DUI License Suspension Law

2011 has brought some very meaningful changes in the law regarding driver license suspensions when a motorist is charged with Driving Under the Influence of Alcohol. Vehicle Code Section 13353.1 became law. Now if you are charged with a second offense D.U.I. you can get your restricted license back after only 90 days of suspension. To get your license back you will have to enroll in an 18 month drinking driver program and agree to put an ignition interlock device on your vehicle. This device will remain on the car for the remainder of a year. This change in the law is obviously a big benefit to the 2nd offenders as in the past you could not get your license back until a one year suspension ran.

Bad for first offenders is a law that has been in effect in Sacramento County since July, 2010 which makes it mandatory that all those convicted of a D.U.I. must place the ignition interlock device on their vehicles. The device will have to be on the vehicle for a period of six months. This is a pilot program and is in effect in Alameda and Los Angeles County as well.
