			<content:encoded><![CDATA[<p>The <a href="http://www.supremecourt.gov/" target="_blank">U.S. Supreme Court</a> found yesterday that it is an unconstitutional infringement on a citizen&#8217;s right against government intrusion for the police to secretly plant a GPS device on his vehicle and monitor his movements. In making the ruling the Court threw out a conviction against a man found to have been guilty of drug trafficking.  </p>
<p>The decision was unanimous and held that the government must obtain a search warrant from a Judge before secretly monitoring an individual. Some Justices even went further to indicate that in future cases they would find that using of other satellite devices such as a cell phone would be an unconstitutional intrusion under the <a href="http://www.archives.gov/exhibits/charters/bill_of_rights_transcript.html" target="_blank">4th Amendment</a>.<span id="more-833"></span></p>

We know that this is a time when there are a lot of Holiday parties and sometimes those parties involve drinking. Please be extra careful during these times to avoid driving after you have had any more than one drink. One drink would probably be safe for anyone and you would most likely not have enough alcohol in your system to reach the legal limit for intoxication. However, you should not drive after drinking any more than that. Be aware that the CHP often have increased DUI checkpoints during this time and they can stop you without any cause at all. </p>
<p>In case you are stopped make sure that you have your proof of insurance and registration handy. Often the best way to handle a detention is to be extremely polite and helpful with the police officers. Do not do anything to question their authority. Take an alcohol test if requested to do so. Refusal to take a test can have disastrous effects on your license. When asked questions by the police officers, be as accurate as possible. To tell them that you have had two drinks is a sure sign to them that you are hiding something – everybody says this no matter the level of their intoxication. If you do not tell the truth and your case goes to a trial, it will not look good if you change your testimony at trial. </p>
<p>However, be aware that you have no duty to allow the police to search your car. Law enforcement&#8217;s preferred way to make a search is to get permission from the owner. You have no duty to give permission and if you have any doubt, you should refuse permission. If you refuse permission the police will have to get a search warrant to search your car or risk having anything they find thrown out in court. However, you must allow the police to search your person if they have detained you.</p>
<p>If you are arrested for DUI, remember that you have only 10 days to request a hearing before the DMV as to whether your license will be suspended. I always advise my clients to request a hearing even if they believe they are guilty. There may be some procedure that the police failed to follow that an attorney can uncover. Also, you may end up being below the legal limit.</p>

			<content:encoded><![CDATA[<p>2011 has brought some very meaningful changes in the law regarding driver license suspensions when a motorist is charged with Driving Under the Influence of Alcohol.  Vehicle Code Section 13353.1 became law. Now if you are charged with a second offense D.U.I. you can get your restricted license back after only 90 days of suspension.  To get your license back you will have to enroll in an 18 month drinking driver program and agree to put an ignition interlock device on your vehicle.  This device will remain on the car for the remainder of a year. This change in the law is obviously a big benefit to the 2nd offenders as in the past you  could not get your license back until a one year suspension ran. <span id="more-668"></span></p>
<p>Bad for first offenders is a law that has been in effect in Sacramento County since July, 2010 which makes it mandatory that all those <a href="http://rbowmanlaw.com/criminal-defense/dui-dwi/" title="Sacramento DUI Attorney">convicted of a D.U.I.</a> must place the ignition interlock device on their vehicles. The device will have to be on the vehicle for a period of six months. This is a pilot program and is in effect in Alameda and Los Angeles County as well. </p>

<p>This program, called Secure Communities, has raised criticism from immigrants-rights groups that are protesting nationwide and arguing that the program leads to distrust between immigrants and the police. It also has been criticized due to the fact that it allows the federal government to detain people being investigated for relatively minor crimes.</p>
<p>ICE defends the policy saying that the intent is to catch and deport illegal immigrants with criminal records.</p>
<p>The program is basically a data-sharing system that allows the FBI and Department of Homeland Security to share fingerprints and use them to identify illegal immigrants.</p>

			<content:encoded><![CDATA[<p>Texas put to death convicted sex offender Guadalupe Esparza on Wednesday for raping and strangling a 7-year-old girl.</p>
<p>The man snuck into a San Antonio apartment at night and removed the girl from the apartment for the crime.</p>
<p>The girl was found hours after she was reported missing in the weeds near a convenience store near her home in 1999. The baby sitter that had discovered her missing recognized Esparza as having been at the residence earlier in the night, and police discovered blood splattered clothing in a trash-bin at his apartment. Semen on the body linked him through DNA testing to the crime scene.</p>
<p>Several appeals were made to review claims that he was mentally impaired and ineligible for execution however none of them were upheld.</p>
<p>His execution is most likely the last of 13 executions in Texas this year.</p>

<p>The stampede took place in 2003 when a fight broke out and club security used pepper spray to try and control the situation. A panic broke out and in the resulting rush to the exits 21 people were crushed to death and 50 suffered injuries.</p>

<p>Many war criminals, including Dr. Josef Mengele, lived full lives after the Holocaust and died peacefully as free men.</p>
<p>In the aftermath of the war many Nazi officers were allowed to go free or escaped, finding refuge in South America and support from fellow officers and sympathetic family members.</p>
<p>Only a small number of people continued to search for them, and there was not a lot of funding available.</p>
<p>Now, few remain and those that do are in their last years, begging the question as to what punishment remains for them.</p>
